WHAT IS INCAPACITY PLANNING?
Incapacity Planning, also known as life planning, is planning for the unfortunate circumstance of becoming unable to manage your finances or make health decisions. Without an incapacity plan, you make it harder for your family and loved ones to manage your affairs should the unthinkable happen to you.
Incapacity planning is a process through which you make choices and plans now about the future. It addresses what you want to happen should you lose your ability to make choices, express your desires, or otherwise lose the decision-making ability you enjoy now.
A standard incapacity plan addresses three key decision-making areas: financial, personal, and health. A smart plan ensures that, should something happen to you, your wishes will be protected, and that someone will have the legal authority to represent your interests. An incapacity plan can include the following: Living Will, Do Not Resuscitate Order, Health Care Power of Attorney, HIPAA Release, Durable Power of Attorney, and Revocable Living Trust.
Our law firm helps clients create a plan to handle their affairs in the event they become disabled, thereby avoiding the necessity of a public Guardianship proceeding.

With the right estate plan, you can rest assured that your family won’t have to endure a public process and face high probate costs. The government will also not be able to take a large portion of what you’ve spent a lifetime building.
